Understand the general terms below.

GENERAL TERMS:   All vehicles and other property are sold “AS IS”, “WHERE IS” (No Warranty).  The Faulkner County Sheriff’s Office does not discriminate based on race, religion, creed, color or national origin.  We encourage participation by all persons.  However, the purchaser must be at least 18 years of age and present identification prior to any bid entry or sale.  The Faulkner County Sheriff’s Office reserves the right to accept or reject any and/or all bids.  Following the success of a winning bid, all winning bidders must satisfy payment in full to the Faulkner County Sheriff's Office Auction Personnel at the time of sale in cash, cashier’s check made payable to Faulkner County, or certified funds from the bank (personal checks cannot and will not be accepted unless prior approval has been granted).  *Suggestion:  Have 100% of whatever you are prepared to bid with you.  Failure to pay balance due will result in forfeit of property to the seller (Faulkner County). 

GENERAL INFORMATION: Sheriff Sales are for surplus, recovered and/or unclaimed seized property only.  The Sheriff’s Office does not know the history of each piece of property auctioned.  However, any prospective bidders can view the property prior to the auction for the purpose of inspecting.  The Sheriff’s Office cannot provide legal advice on how to properly investigate what financial obligations may be outstanding on property acquired through the means of that which is unclaimed. All items purchased must be removed from the premises no later than the day of the sale unless other arrangements regarding pickup has been arranged and granted by the Auctioneer or Sheriff's Office.  Neither the Faulkner County Sheriff’s Office nor the Auctioneer will be responsible for any “sold” items after close of auction. Should you have a legal question, we recommend you consult an attorney.

The Sheriff’s Office does not have specific information about the condition of all property or other pertinent information (i.e. maintenance, how many owners, has the vehicle ever been wrecked, etc.).  Resources available are www.carfax.com

Property sold at auction by the Sheriff’s Office is generally advertised in the Log Cabin Democrat.  

In addition to the newspaper advertising, all notices of sales are posted for public viewing at the Faulkner County Courthouse and on this website.

Sales of property are “open-type” auction sales (no sealed bids).  A minimum bid is called by the auctioneer.  All bidders are required to have 100% payment upon completion of the bidding  and/or auction. 

The highest bidder at the sale shall be the Purchaser.  If any dispute arises as to who may be the highest bidder, the property will be resold in the event the highest bidder cannot be determined.

If you are the successful bidder, a bill-of-sale for the property will be issued to you upon full payment of the bid.  The bill-of-sale gives the winning bidder a clear title to the property.  If a purchaser does not complete the sale following a winning bid, the purchaser can be held liable for a deposit, and for all losses and expenses. 

If you are the successful bidder, you do not own the property until you have satisfied full payment for the property and been issued a bill-of-sale.
